1. Agreement to these terms
MostOverplayed.com (“we,” “us,” or “our”) operates the website and related services available at www.mostoverplayed.com (the “Service”). By accessing or using the Service, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.
These Terms constitute a binding agreement between you and us. We may update these Terms from time to time; the “Last updated” date above reflects the current version. Continued use after changes constitutes acceptance of the revised Terms, except where applicable law requires otherwise.
2. Description of the Service
MostOverplayed.com is an online community where users can browse songs, artists, and radio stations, search the catalog, save favorites, and vote on songs they consider “overplayed.” Votes and related data may be aggregated into rankings, charts, and other displays. Rankings and scores reflect community participation and our processing rules—they are not official airplay or industry charts, and we do not represent any broadcaster, artist, label, or rights holder.
3. Eligibility
You must be old enough to form a binding contract where you live and at least 13 years of age (or the minimum age required in your jurisdiction for consent to data processing, if higher). If you are under 13, or under the age required in your jurisdiction, you may not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
4. Accounts and sign-in
Certain features (for example, voting beyond guest limits or saving favorites tied to your profile) may require an account. Accounts may be provided through our authentication partner (currently Supabase Auth). You agree to provide accurate information, safeguard your credentials, and notify us promptly of unauthorized use if we offer a contact method. You are responsible for activity under your account except where our systems are at fault.
We may suspend or terminate accounts that violate these Terms, risk the Service or other users, or as required by law.
5. Guest use and voting
You may use parts of the Service without an account. Guest voting may rely on a browser identifier we associate with your session. Guest users are subject to daily voting limits and other rules we implement (for example, a cap on how many distinct songs you may vote for per calendar day in our configured timezone). We may ask you to create an account to continue voting or using certain features.
When signed in, you may be limited to one vote per song per calendar day (in our configured timezone), in addition to system-wide protections such as rate limits. You must not attempt to circumvent limits, manipulate rankings through coordinated inauthentic activity, or interfere with how votes are recorded.
6. Acceptable use
You agree not to:
- Use the Service in violation of law or third-party rights, including intellectual property and privacy rights.
- Probe, scan, or test the vulnerability of the Service, or breach or circumvent security or access controls.
- Use bots, scrapers, or automated means to access the Service in a way that overloads, disrupts, or evades rate limits or intended use, except as allowed by public search engines’ standard policies where applicable.
- Upload or transmit malware, spam, or harmful code, or harass, abuse, or harm other users or our personnel.
- Misrepresent your identity or affiliation, or use another person’s account without permission.
We may investigate violations and cooperate with law enforcement as permitted by law.
7. Content, data, and intellectual property
The Service may display song titles, artist names, station names, images (such as cover art), and similar metadata. That material may come from third-party sources or users; respective owners retain their rights. Nothing in these Terms grants you rights to music recordings, compositions, or trademarks beyond what is necessary to use the Service as offered.
The MostOverplayed.com name, logo, visual design, and original text and software on the Service are owned by us or our licensors. You may not copy, modify, or distribute them except as allowed by law or with our written permission.
You retain any rights you have in content you submit (for example, if we add features that accept user-submitted text). By submitting content, you grant us a worldwide, non-exclusive license to host, use, reproduce, modify, and display that content as needed to operate and improve the Service, subject to our Privacy Policy and applicable law.
8. Third-party services
The Service relies on vendors for hosting, authentication, databases, analytics, and other functions (for example, infrastructure and auth providers). Their use is subject to their terms and privacy policies. Links to third-party sites are not endorsements; we are not responsible for third-party content or practices.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT RANKINGS OR DATA WILL BE ACCURATE OR COMPLETE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MOSTOVERPLAYED.COM OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT PAID US ANYTHING.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.
11. Indemnity
You will defend, indemnify, and hold harmless MostOverplayed.com and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.
12. Changes and availability
We may modify, suspend, or discontinue the Service or any feature at any time. We will try to give reasonable notice for material adverse changes where practicable, but we may make emergency or compliance-driven changes without notice.
13. Governing law and disputes
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles, except where preempted by federal law. Courts in the United States with competent jurisdiction may hear disputes arising from these Terms or the Service, subject to mandatory consumer protections in your jurisdiction that cannot be waived.
Important: If you are a consumer in the European Economic Area, United Kingdom, or other region with mandatory local law, nothing in this section limits your statutory rights or remedies.
14. General
These Terms are the entire agreement between you and us regarding the Service and supersede prior agreements on the same subject. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
